I. INTRODUCTORY PROVISIONS
These Terms and Conditions apply to purchases made through the online store www.allstarshop.cz. They govern the rights and obligations of the seller and the buyer and form an integral part of each purchase agreement concluded via the online store.
Definitions:
a) Buyer: A consumer is an individual not acting within the scope of business or self-employment when entering into a contract. A non-consumer buyer is considered a business customer. These terms apply to consumers unless explicitly stated otherwise.
b) Seller: The seller is an entrepreneur who acts in the course of their business when entering into and fulfilling the contract.
c) Civil Code: Act No. 89/2012 Coll., Civil Code, as amended.

The seller is not bound by any codes of conduct and does not provide after-sales service.
II. BASIC INFORMATION
Information about goods is provided with each product. Prices include VAT and fees but exclude delivery costs. Payment methods:
a) Online card payment – free
b) Bank transfer – free
c) Cash on delivery – 59 CZK / 2.4 EUR
The seller reserves the right not to accept modified offers. Contract confirmation that deviates from the actual agreement has no legal effect.
The seller ensures authenticity of product reviews by linking them to verified purchases. Usage instructions are available online or on packaging.
III. ORDERING AND DELIVERY
Contracts can only be concluded in Czech. Buyers place orders via the online store. The final summary includes total price, delivery, and payment methods. Orders can be edited before submission. The order is confirmed once the buyer clicks “Order with payment obligation.”
Order confirmation is sent via email along with these Terms and Conditions. The seller must deliver goods within 30 days unless otherwise stated, and usually ships within 2 business days if the product is in stock.
Goods are delivered via Zásilkovna (delivery: 119 CZK / 4.1 EUR; pick-up: 79 CZK / 3.6 EUR). Free shipping applies for orders over 5000 CZK / 201 EUR. Personal pick-up in Znojmo/Ostrava is free.
Title passes upon full payment and receipt. Risk passes upon receipt, or at the moment the buyer refuses to accept the delivery (excluding damage-related refusals). Storage fees may apply for unclaimed orders (10 CZK/day, up to 500 CZK). Repeated delivery may be charged.
Goods are delivered within the Czech Republic and Slovakia.
IV. CANCELLATION AND WITHDRAWAL
The buyer can withdraw from the contract within 14 days of receiving the goods, without providing a reason. Withdrawal before delivery is also possible. The buyer should state purchase date, invoice number, bank details, and return method.
Refunds are issued within 14 days using the same payment method, but the seller may wait until the goods are returned. The goods must be returned clean, complete, preferably in original packaging. Return shipping is paid by the buyer.
The right of withdrawal does not apply in certain cases (e.g., custom goods, sealed hygiene products, expired goods, digital content downloaded before withdrawal, etc.).
Gifts received with goods must be returned if the buyer withdraws from the contract. Goods sent back without a valid withdrawal will be returned at the buyer’s cost.
V. DEFECTIVE PERFORMANCE RIGHTS
The seller is liable for defects present at delivery or manifesting within two years (or one year for used goods). The buyer may request repair or replacement. If not possible or disproportionately costly, a discount or withdrawal is possible.
Used goods may have shorter warranty periods and expected wear. If a defect appears within one year, it is presumed to have existed at delivery. The buyer is not entitled to rights for damage caused by improper use or wear and tear.
VI. CLAIM HANDLING
Claims should be submitted without delay, using the form provided. The buyer must provide proof of purchase and describe the defect. The seller must resolve claims within 30 days unless agreed otherwise.
If the claim is not handled in time, the buyer may withdraw from the contract or request a discount. If the buyer doesn’t collect repaired goods, storage fees may apply.
VII. PERSONAL DATA PROTECTION
The seller processes personal data in accordance with the GDPR for the purpose of contract execution, including order handling and delivery. Data processed include: name, address, email, phone, payment details, and business identifiers where applicable. Full privacy information is available under “Privacy Policy.”
VIII. DISPUTE RESOLUTION
The seller handles complaints via email. If not resolved, consumers may turn to the Czech Trade Inspection Authority (www.coi.cz) for out-of-court dispute resolution. The buyer may also use the EU’s online platform at https://ec.europa.eu/consumers/odr/.
During dispute resolution, statutory limitation periods are paused.
IX. FINAL PROVISIONS
Matters not covered here are governed by the Civil Code and Consumer Protection Act. The contract is governed by Czech law. The buyer consents to receiving commercial communications. The buyer assumes the risk of change of circumstances under § 1765(2) of the Civil Code.
